Chances are it won't affect its street legality here in the UK as stated previously the only regular check is the MoT and that doesnt test emissions. Also it only needs to meet its homologated spec when its sold so after that even official dealers can sell accessories/upgrades. Lotus Cars used to offer an ECU upgrade to its recent (2007) Europa, ie it was sold with ~200bhp and crucialy 225Co/kg so as to fall into a vechicle tax bracket but some left the dealers with the ECU upgrade to 225bhp and unknown CO (but as that was set at sale spec the tax bracket was unchanged) so plenty of scope to upgrade ;D. The kit exists albeit in beta form but when it is rolled out, the dealer will be able to tune your bike as you want it and that map becomes yours.
I have yet to find out if they will be able to delete the deliberate power reduction in the lower gears of the new Super Tenere. We wait....
