Because a motorcycle comes from the factory with a passenger seat, and if a passenger squirms around that is not against the law, dump the passenger. However, your set up would be considered an unsafe load, does not matter how secure it is, it extends far beyond what the manufacturer allowed for when building the machine. This law can be applied to almost any vehicle on the road. In Europe they often do road side safety checks/stops, checking tyres, lights etc, even if a child is secure in a child seat, and until recently in Switzerland, you had to carry a spare pair or prescription glasses if you need corrective lenses of any kind...... just in case.
