Advice please: Getting run around from 2 different Yamaha dealers!!

ADVICE PLEASE:
I am getting the run around by two different Yamaha dealers in Alabama. I bought a Yama FJ-09 in May of 2015 at Powersports of Montgomery, Montgomery, Al. and financed in 60 mos of GAP, Extended Warranty/Maintenance and a tire protection plan. I was told it was all fully transferable. I traded that FJ9 in in December for a 2015 SupTen at Big # 1 Motorsports in Birmingham, 99 miles north. They would not accept my previously financed GAP, Ext Maint/Warranty, etc saying because I did not buy the FJ09 there that I would have to go back to Montgomery and cancel it all there.

So I financed a new tire protection plan, ext warranty/Main plan and gap when I got the new SupTen at Big#1 and went to Montgomery and signed papers to cancel all the first ones. Well, they said I had nothing coming from the tire protection plan due to the fact they had to replace a rear tire. Ok. I got a refund from Montgomery Honda/Yamaha (Montgomery Powersports), but never got the GAP refund. Now Montgomery has been saying Big#1 has to cancel and refund that.

I have been going back and forth between Montgomery Powersports and Big # 1 Motorsports for six months, since December, each one always saying the same thing, that the other one is supposed to refund my GAP plan, not them, etc. Just got off the phone with both of them and again each one says it is the other's responsibility. Montgomery says Big#1 should pay it since I traded in there and they should have cancelled it. Big#1 says that Montgomery has to do it because that is where I financed the GAP in the first place.

I am so sick of this. I am just about ready to go talk to a lawyer or something. But of course I have no frigging money for a lawyer. So I guess I am screwed!

Not 100% sure of laws in the US, however, as GAP and Tire protection are both insurance products, you should be able to cancel and have the 'unused' time refunded, as long as no claim has been made on either. You may be better off going direct to the source, the Gap and tyre protection supplier and have them cancel the policy. The dealers are reluctant to cancel as the may be liable for a clawback of commission paid to them. Good luck either way.

These are normally insurance contracts that the dealerships buy independent of Yamaha, just as if each were going to Staples to buy writing pens, marking up the price, and then selling you a pen. You sound like Montgomery sold you a red pen (warranty/service) and a green (tire) one for the FJ09. And then you bought a set for the Tenere from Big#1.

If I hearing this right, it's Montgomery who may owe you what's left on the FJ09 insurance contracts. And you are now a Big#1 customer who might buy more products there, so if you sweet talk the finance person at Big#1 you may be able to get them on a conference call with you and Montgomerys' finance person.

If not, you could try the Yamaha Area Rep. Not sure how far this will work, as the contracts are not really Yamaha products.

Hello all,
I got it straight y'all. Finally called Yamaha Corporate Customer Relationship and they told me to call Honda Gap directly, which is who the GAP was with. I did so and Honda, nice as can be, emailed me the form I need to fill out and then scan and send copies of it and my contract back to them. Should get the money in 2 to 3 weeks. See, seems to me one of those shops should have taken care of that crap. Glad that head ache is over with.

Cancelling within 6 months, the dealership loses all of it's markup on those policies and the finance person would have to give back his/her commission, the last thing they want, so they don't ever want to help out. Each dealer may use different companies for gap and tire packages, that's why the 2nd dealer told you the 1st dealer who sold it all to you has to cancel it. You going to the insurance company directly was the best way to handle it. Now, did they tell you how much of a refund you will be getting? If 100%, that would be a miracle. They usually have some jacked up pro-rated formula...

When I cancelled the GAP insurance I had to go to the original dealer. I took the price paid for it, divided it by the total months financed to get a monthly cost. Multiply that by the remaining months left on the finance note and that should put you in the ballpark of the amount of refund. My estimate and what I actually got a check for was $17.00 difference. It took 6 weeks to receive the refund.

Ok, I bought the FJ09 in May of 2015 and traded it in on the SupTen in December of 2015, and here it is April 20016. They told me I will get $320 bucks. Better than nothing.
