LeoVince LV-One Evo and OEM panniers

A few years ago I replaced the OEM exhaust on my 2011 Gen1 with a LeoVince LV-One Evo and I've been very happy with it both acoustically and visually. I was going to keep the OEM in case I ever sold the bike to buy a Gen2, but unfortunately it was stolen from my driveway within 24hrs of me fitting the LeoVince! Annoying but not a major issue. A year later I was going away and put the OEM panniers on... except I couldn't! They don't fit! The exhaust sticks out about 2-3cm too far from the side of the bike. I know I fitted the exhaust properly with all correct parts and I know that there is no other way to fit the bike with the parts provided, and with the OEM parts that are re-used. There is a bolt of a fixed length that defines the position and the "space" between it and the bike frame is filled by the LeoVince spacer. It was the correct model for the bike. I should probably have checked at the time with the retailer (an Ebay business seller) but I'm just wondering... has anyone else had this problem?
