When you mount and tighten the top panniers nuts, there is a HUGE gap on passenger foot pegs, 1cm on the right more than 2 on the left side.

ok if i loosen all nuts and I tighten hard all nuts, it is working but as a technician, this is quite unusual, almost like an amateur mistake

You are supposed to have spacers there.
The instructions from Bumot says that if you do not have the original Yamaha luggage brackets attached to the passenger foot-peg brackets, then you need the spacer kit. (I believe I had to order it separately)
You could probably just get some spacers at a local hardware store.
